Legal, Risk & Strategy

Environmental features, conditions and constraints present complex risks to a wide variety of projects. Often, there are legal ramifications for certain pathways and decisions that require careful consideration based on cost, time and reputational risks. Occasionally, disputes require legal intervention which can result in proponents incurring liability.

Conversely, the identification of environmental opportunities often represents the ability to derive commercial benefit for savvy, informed proponents. The identification of such opportunities is a key differentiator of our service offering.

We take the time to develop a detailed understanding of each individual client’s risk tolerance. We then prepare tailored strategies and advice to meet their exact needs.

Our range of legal, risk and strategy services include:

Expert Opinion and Technical Review

Directors Dale Newsome and James Gibson provide expert opinion to support legal firms, landowners, government organisations, insurers and other third parties in matters before the State Appeals Tribunal, other legal proceedings or for peer review purposes. Dale Newsome has provided expert legal advice for matters pertaining to land development and extractive industries applications and has supported appeals against decisions for mining activities. James Gibson routinely provides expert advice to legal firms, insurers and clients in relation to cost and liabilities associated with land contamination and remediation, including expert advice where matters have been escalated to dispute resolution, arbitration or litigation.

Due Diligence to Closure – Integrated environmental assessment and management

From inception to completion, we support our clients throughout the project lifecycle and use our knowledge of what is required at project completion to inform the due diligence and assessment process. Our experience allows us to consider the whole project picture, guiding our clients toward successful completion and closure of projects, minimising time and cost risks.

Offset Strategies

Our experts can negotiate and coordinate offsets for impacts to significant environmental values and carbon footprints. We maintain established networks with regulators and land managers and can capitalise on opportunities for our clients through our active participation in offsetting programs.

Land Asset Environmental and Commercial Value Maximisation

Our strategists unlock environmental and commercial value of land assets for organisations.

For example:

  • Finding the most cost effective or land efficient means of managing contaminated material, developing innovative or risk-based approaches as an alternative to the typical “dig and dump” approach.

  • For a large land holder, distinguishing land which is valuable for conservation and potentially has commercial or strategic value as an offset versus land which is developable.

Stakeholder Engagement and Community Consultation

We utilise our knowledge of government processes, established networks and communication capabilities to guide engagement and establish project credibility with regulators, stakeholders and the community.
